More Than Ten Year Later, Dr. Rajan Mahtani Gets Final Justice On The Portland Cement Zambia Case

Dr. Rajan Lekhraj Mahtani is a noted businessman and philanthropist in Zambia. On 31st January 2019, he finally received the hearing for which he was patiently waiting for more than a decade. This news was with respect to Portland Cement Zambia, a long-pending case registered at two different courts. The case of Portland Cement Zambia is age old and was first registered at the Lusaka High Court by Dr. Rajan Mahtani claiming that his factory was unethically taken from him. Despite sharing several evidences and testimonials, the judge at the Lusaka High Court failed to provide the right judgement. The judge at the Lusaka High Court was justice Nkonde who gave the final decision during the month of May 2018. According to this decision, Ventriglias were announced as only shareholders of the Portland Cement Zambia.

After this misdirected decision, Dr. Rajan Mahtani then approached the Court of Appeal. The Court of Appeal is one of the highest-level justice providers in Zambia. The judge at the Court of Appeal was justice Mwinde who gave the final decision on 31st January 2019 after looking into all evidences and testimonials. This decision was given around nine months after the case was registered there, sharp contrast with the Lusaka High Court which took more than a decade to provide a concrete judgement and that too was misdirected.

According to the final decision from the Court of Appeal, Finsbury Investments is the majority shareholder at the Portland Cement Zambia as it holds 58 percent shares at the factory. On the other hand, Ital Terrazzo Limited holds just 42 percent shares at the factory and are the minority shareholders of the factory without any legal ownership over the factory. Finsbury Investments is a company owned by Dr. Rajan Mahtani and this clearly establishes the fact that Dr. Rajan Mahtani is the majority shareholder and actual owner of the factory.
